PARTICIPATION AGREEMENT:
"Mountaineering, remote trekking and skiing carry an inherent risk of injury and death, which cannot be eliminated. You must accept that although we do our utmost to reduce any risks to an acceptable level, there are chances of accidents happening."

Booking Conditions:

  1. All bookings are made with Jagged Globe Limited, Registered Company Number 3069133 (hereinafter referred to as The Company) whose registered office is The Foundry Studios, 45 Mowbray Street, Sheffield S3 8EN, United Kingdom. The Directors of The Company are Stephen Bell, Simon Lowe and Tom Briggs.
  2. The air holidays and flights in this brochure are ATOL protected, since we hold an Air Travel Organiser’s Licence granted by the Civil Aviation Authority. Our ATOL number is ATOL 4019. In the unlikely event of our insolvency, the CAA will ensure that you are not stranded abroad and will arrange to refund any money you have paid to us for an advance booking. For further information, visit the ATOL website at www.atol.org.uk
  3. As a member of the Association of Bonded Travel Organisers Trust Limited (ABTOT) an Association approved by the Department of Trade and Industry, Jagged Globe has provided a Bond to meet the requirements of the Package Travel, Package Holidays and Package Tour Regulations 1992 in respect of non-flight inclusive packages only. This gives UK residents full protection in the unlikely event of our insolvency. For more information, visit www.abtot.com
  4. To book a place, complete, sign and date the Booking Form and post it to The Company with your deposit of £150 per person, per course together with the premium for your insurance if required. If booking within 28 days of the course start date, we require full payment when the booking is made. Unless the course is full, you will receive confirmation of booking and Course Joining Instructions.
  5. Deposits are non-refundable. We advise you take out travel insurance at the same time that you book.
  6. The final balance of the course cost should reach The Company no later than 42 days before the start of the course. If the balance is not received by the specified date, we reserve the right to cancel your booking and your deposit will be forfeited, unless a Director of The Company has agreed to a delay in your payment.
  7. When sending money to the company, the total amount received by our bank must be no less than the full amount shown on your invoice. If sending money by electronic (bank) transfer then you must pay the remitter's (your) fees and the beneficiaries (our) fees.
  8. If payment is made by credit card, a 2% charge will be added to the amount due to The Company (this applies to all payments; deposits, interim payments, final balances and miscellaneous purchases.) This charge is imposed by the credit card payment service provider and is used, in part, to provide consumer protection for goods and services purchased, in accordance with the terms and conditions pertaining to the credit card being used. This charge can be avoided by using a debit card (for deposits, for example) or by sending a cheque (for final balances).
  9. Notice of cancellation must be given in writing. Should you cancel, the following scale of charges will apply:
42 days or more before the course starts - Loss of deposit
21 days or more but less than 42 days before the course starts - 50% of total trip cost
Less than 21 days before the course starts - 100% of total trip cost
  10. Similar terms are adopted throughout the travel industry. They cover the costs of advance payments made by The Company as well as protecting the contractual obligations between The Company and our guides or leaders. Cancellation charges may be covered, in part, by your travel insurance provided the reason for cancellation falls within the terms of the policy.
  11. If you wish to transfer from one course to another, an administration charge of £60 per person, per booking, will be payable up to the time that the final balance becomes due and assuming there is availability on another course. A transfer request after the final balance is due will be treated as a cancellation request and the transfer fee will not be accepted. A transfer request must be notified in writing and will not be actioned on the original course booking until the administration charge has been received.
  12. You may transfer your booking more than once, as long as you pay the transfer fee on each separate occasion, at the rate prevailing at the time of payment. The final course to which your original deposit is transferred must start within 18 calendar months of the start date of the course originally booked. Failure to travel within this time will be taken as a disinclination to travel and as a de facto intention to cancel the booking, regardless of the payment of any transfer fees in the intervening period. Under such circumstances, the deposit and any money paid to affect a transfer, or transfers, will be forfeited to The Company.
  13. We reserve the right to cancel any course if there are insufficient bookings. If the course you have booked is cancelled, you will be given the opportunity to transfer at no extra charge. We will make a full refund if other course dates are unsuitable.
  14. If your course is cancelled by The Company, for whatever reason, we will not be liable for any costs or losses incurred by you in respect of any travel arrangements, or leave arrangements, you may have made or alterations you make to those arrangements subsequent to the cancellation.
  15. Group / course sizes described on this website are target sizes and may be increased or decreased at the discretion of The Company. We give no undertaking as to the minimum size of a group or course. Similarly, Course Directors, guides, instructors, or leaders named in course descriptions may also be changed.
  16. It may be necessary to move your booking to another course so that our courses have an optimum number of participants according to the instructor/participant ratios stipulated for the activities to be undertaken. You will not be charged for such a transfer instigated by us.
  17. The guiding/instructing ratios for any course or activity may be varied to allow for circumstances such as staff absence or illness, so long as such changes do not compromise the safety of course members or infringe any guidelines concerning guiding/instructing ratios as may be set out by national authorities, the UK national governing bodies of the activities to be undertaken or concerned professional associations, such as the International Federation of Mountain Guides Associations (IFMGA / UIAGM) or the Association of British Mountain Guides (BMG).
  18. The programmes we publish in our literature and on our website, and describing the courses in this in this brochure, are designed to be illustrative in order to best explain the scope and type of activities you will be undertaking. It is very unlikely that any one programme could be or would be followed precisely as it is published. Several factors outside of our control will determine this and dictate what can be accomplished reasonably during your course. The most influential factors will be the weather, the conditions on the mountains and the physical fitness of course participants. Taking these factors into consideration, and the aims of the course as described in our literature, the Course Director will construct the best programme possible. The Course Director will review and may alter the programme as the course progresses in response to the changing influence of these factors.
  19. Once the course is underway, the Course Director, guides, instructors, or leaders may change routes, mountain objectives or activities, at any time, if they believe that to continue as intended would place themselves or any course member at undue risk. This applies to all courses, including those that have a specific mountain or route as their primary objective (Mont Blanc, for example).
  20. Circumstances may arise where we are forced to alter dates, duration, or hotel accommodation before a course starts. We will try to inform you of any such changes as soon as we know of them.
  21. Our Course Directors, guides, instructors, and leaders will do their utmost to ensure that any problems are solved for the benefit of the course participants as a whole. Signing the booking form signifies your acceptance of the Course Director's authority to make decisions affecting the group or individuals. For instance, the Course Director may require an individual, or individuals, to leave the course if they believe that a person or person's health is at risk, if a person is not coping, or may not cope, with the technical, physical or mental demands of the course, if an illegal act has been or may be committed, or conduct is, may become, or has been, detrimental to the safety, enjoyment or well-being of the group or of any individual within the group.
  22. Most courses have days in the itinerary that are included to provide flexibility in case of bad weather, or some other untoward event, and thereby increase the chances of your principle objective being achieved and for your course to be successful. If these days are not needed in order to achieve the aims of the course and the group decides to return from the mountains early, any additional costs incurred by you and associated with extra hotel nights, or services that would not otherwise have been provided nor were given in the published itinerary, must be met by you at the time.
  23. We receive regular Travel Advice from the UK Foreign Office (FO). We will not knowingly operate courses in contravention of such advice if it is published before the due start date of a course.
  24. We will cancel a course if the FO Advice effectively puts the destination country or significant parts of the country out of bounds such as to make the principal objective untenable. If the principal objective remains achievable in observance of the FO Advice, we will alter the itinerary and the course will not be cancelled. For example, the FO may advise that it is unsafe to traverse a region that lies on the published approach route. In such circumstances, if the activity area can be reached by using an alternative route, we will do so and the trip will not be cancelled.
  25. If the FO does not issue unambiguous advice against travel, a disinclination to travel on the basis of a perceived threat or hazard, howsoever formed, will be interpreted as a voluntary cancellation and the cancellation charges set out in these booking conditions will apply. This does not affect your right to transfer your booking under the terms of these booking conditions.
  26. Non-UK Nationals should consult their own government for advice on travel to the destination country and all countries transited en route. We will not be bound by the advice of such foreign governments, nor will our booking conditions be waived, save where such advice coincides with the advice of the UK Government, and the booking conditions above become effective.
  27. A client leaving a course at any stage, for whatever reason, will not be entitled to any refund unless agreed by a Director of The Company.
  28. Courses that involve activities at altitudes in excess of 3,000 metres carry an inherent risk of altitude illness. Similarly, some of our trips visit remote locations or poorly developed regions where infrastructure is limited. In such places, the risks to health are increased and the ability to treat injury or illness effectively is reduced. Being in the mountains, whether climbing, mountaineering, skiing or trekking, carries an inherent hazard with an attendant risk of serious injury or death. By signing these booking conditions you acknowledge these hazards and your acceptance of the associated risks.
  29. Neither The Company nor any of its representatives will be responsible for any illness, injury or death sustained on our courses, nor will they be liable for any uninsured loss of personal property.
  30. The Company cannot be made liable for the consequences of strikes, industrial action, wars, riots, sickness, quarantine, government intervention, weather conditions, the failure of a scheduled airline, or other untoward occurrences, whatever they may be.
  31. In the event of civil unrest in a particular region, we undertake to inform our clients of the situation as soon as we have knowledge of it.
  32. For all courses, you are advised to have insurance that covers you for all of the activities to be undertaken. For all non-UK courses you must have adequate insurance for mountaineering including cover for search, helicopter rescue and medical repatriation.
  33. Having made every effort to ensure the correctness of this website, we cannot be held responsible for any inaccuracies.
  34. Prices on this website are based on costs and exchange rates as at 04.11.2008. Prices may change without notice and vary from those published in our brochure. Current prices are published on our website. We sincerely hope that surcharges will not be necessary, but in the unlikely event that they are, you may cancel your booking without penalty if the surcharge amounts to more than 10% of the cost of the Course.
  35. The Company's agents and representatives, other than a Director of The Company, are not entitled to promise refunds for whatever reason, and The Company will not be bound by any such promises.
  36. These booking conditions may only be waived in special circumstances, and in writing, by a Director of The Company.
  37. The terms and conditions of all agreements made with The Company shall be subject to, and governed by, English law.
  38. When making your booking it is implied and accepted that you have read and understood all these booking conditions and agree to abide by them.
